Recently, we had the opportunity to assist one of our valued members who reached out to us seeking advice regarding the necessary changes to their business structure and the MOT testing procedure.

The member, a dedicated professional in the automotive industry, was in the process of transitioning their business from being a sole trader to a limited company. Understanding the complexities involved in such a change, they sought clarity on the procedure required with the Department for Transport (DVSA) for MOT testing under the new business structure.

In response to their query, we promptly addressed their concerns, providing them with the necessary information and guidance. According to the guidance found in the MOT Testing Guide, any significant changes to the control or operation of a business must be notified to the DVSA within 28 calendar days. This applies to various situations, including transitioning from a sole trader to a limited company.

We emphasised the importance of notifying the DVSA within the specified timeframe to avoid any potential disruptions in their MOT testing activities. Failure to do so could lead to the suspension of the VTS's (Vehicle Testing Station) approval to conduct MOT testing until an acceptable application is received.

To ease the process, we advised the member to provide the DVSA with a full and complete application, including all necessary details and documentation related to the new business structure. We encouraged them to keep the DVSA informed of any changes in the officers of the company or any relationship changes to any parent company, if applicable.

Recognising that every business's situation is unique, we also suggested that the member consider seeking personalised advice and assistance from an Authorised Examiner Consultant. These experts are well-versed in industry regulations and can offer tailored guidance to ensure a seamless transition for their MOT garage while addressing any additional compliance requirements that may arise.

Additionally, we provided the member with the DVSA's contact information, specifically directing them to reach out to motadministration@dvsa.gov.uk for further advice and specific queries. We assured them that the dedicated team at DVSA would be more than willing to offer comprehensive support and address any additional concerns they may have.

During our communication with the member, we also expressed our best wishes for their health during this period of change. We understand that health-related reasons may prompt the need for business adjustments, and we hope that the transition to a limited company and the continued operation of their garage will be successful.
